The state of Delaware has implemented a change recently that requires Home Owners Associations to supply data on their community such as bylaws, budgets, any assessments noted, delinquency etc……upon a contract being submitted. This costs the seller anywhere from 0to $200.. There are exceptions due to size of community and when it was established. This is the applicability chart for DUICOA to see if your community is under these regulations. This was done so that the buyer is sure that the community is in good financial health.

  The Loan… Single Family Home or Condo??

Fannie Mae charges lenders a higher cost to warrant a condo versus a single family home to a bank/lender. This is passed along to the buyer in a higher interest rate of about .25%. NOTE  depending on Lender a down deposit of 25% might eliminate this increase rate.

All Banks do  Questionnaires… on Condos…  The long form is used if putting less than 25% down and a requires HOA budgets, and is extensive

If the community is not Fannie Mae warranted 25% down will be required by Fannie Mae in Condo community.

If 1 person owns more than 10% Fannie Mae regs are not met.

If investor owned share of the community is greater than 51%  Fannie wont warrant the loan

If the delinquency rate of HOA dues is over 15% Fannie will not warrant the loan limiting buyers to Cash.

Single family homes interest rates are lower due to Fannie Mae charges being less to warrant loan. approx .25%

Questionnaires sent to HOA on single family homes  are simplified and Lenders are not regulated by Fannie Mae as much as Condos.

Lenders are not examining  the state required DUCIOA docs which is similar to a condo Questionnaire  because they are not required. BUYERS SHOULD.

Some of the biggest issues causing delays in settlement in Delaware is at the last minute the Lenders receive questionnaires with incorrect information by the HOA association. . Ex. Investment or second home density question …..If the owner uses the property for his own enjoyment a few times per year its not a  investment home its a second/vacation home it should not be counted as investment. Just because it gets rented does not mean its a investment property.
